Male drives drunk in Breathalyzer costume
At 1:30 a.m. Sunday officers observed a car traveling the wrong way on East Park Place, a one-way street, with no headlights on. The driver was stopped and as officers approached they observed him stuffing chewing gum in his mouth. Officers observed an open container of Bud Light beer in the center console of the car and when the subject reached into the passenger seat for his wallet and I.D. they saw a partial case of Bud Light on the floor in front of the passenger seat. The subject was identified as James Miller, 20, of Cincinnati.
Miller reportedly had glassy eyes but told police he had not been drinking. When he was asked to exit the car to perform field sobriety tests, officers observed he was wearing a Breathalyzer costume. Miller reportedly performed poorly on field tests and was taken to OPD where they found partial cases of Natural Light beer in his trunk and a fake Ohio driver's license and his mother's driver's license in his wallet. When Miller was asked to take a real Breathalyzer test he reportedly told police he was a nursing student so he knew his BAC would be over the limit.
Miller reportedly blew a 0.158 and was charged with operating a vehicle while intoxicated, underage intoxication, possession of a fake I.D., open container and failure to obey a one-way street before he was released to his girlfriend.
